TERMS OF SALE 

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and there are no guarantees as to delivery times. In order to use the Services made available by the Web Site you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. We retain the right to refuse any request made by you. If your order is accepted we will inform you by e-mail and we will confirm the identity of the party which you have contracted with. This will usually be the BARBARA I GONGINI Brand or may in some cases be a third party. Where a contract is made with a third party, the BARBARA I GONGINI Brand is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. OUR CONTRACT 

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this e-mail will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

 

PRICING AND AVAILABILITY

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices are inclusive of VAT inside EU. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Payment Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

GOVERNING LAW AND JURISDICTION

These terms and conditions are to be construed in accordance with the laws of Denmark and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Danish courts.

 

ENTIRE AGREEMENT

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and the BARBARA I GONGINI Brand. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of the BARBARA I GONGINI Brand.

 

ETHICAL SOURCING POLICY

As a reputable and trusted business committed to offering its customers high quality products, the Barbara I Gongini Brand recognizes its obligation to ensure that suppliers are operating ethically. We expect our suppliers to consistently provide an environment which protects their employees' health and safety and basic human rights. All suppliers are expected to comply with their national employment laws and regulations with particular regard to:

The BARBARA I GONGINI Brand will never knowingly source stock from countries which are in breach of the above principles. We also look to our suppliers to instil these principles when dealing with their own supplier base. Because of the sometimes complex nature of our suppliers' supply chain, it is not always possible to monitor and control the conditions of each individual involved in the production of our products. However, as BARBARA I GONGINI Brand continues to grow it recognises the importance of being proactive and doing everything within its power to support the rights of those involved in the manufacture of its goods.

 

FORCE MAJEURE

If the BARBARA I GONGINI Brand is prevented or delayed (directly or indirectly) from making delivery of the Products or any portion of the Products on the agreed date of delivery or from otherwise performing this or any part of this agreement by reason of act(s) of God, war, embargo, riot(s), strike(s), lock-out(s), trade dispute(s), fire(s), break-down, inclement weather, interruption of transport, Government action, delay in delivery to the BARBARA I GONGINI Brand of any goods or materials or by any cause whatsoever (whether or not of like nature to those specified above) in each case outside such the BARBARA I GONGINI Brand's control («force majeure»), neither party hereto shall be under any liability whatsoever to the other party by reason of such event.

 

APPENDIX

 

RETURN POLICY

Order Cancellations Under the United Kingdom's Distance Selling Regulations you have the right to cancel your order for any item purchased from the BARBARA I GONGINI Brand's, for a full refund. Order cancellations must be made by submitting an email to: shop@barbaraigongini.dk

If however your order has already been processed, you will need to return the order to us. Please read the Return or Exchange an item section below. Return or exchange an item If you are not completely satisfied with your purchase, simply return the item or items to us in their original condition within 14 days of receipt. We will issue a full refund (excluding original delivery charge) on receipt, or exchange the item for a different size / colour if preferred. Please note:

The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

The cost of returning the item to us is your responsibility.

The parcel can take up to 7 working days to be returned to our warehouse, unless sent via special delivery.

To return an item you need to write an email to: shop@barbaraigongini.dk. Please send the returned parcel  the following address and remember to state the address of the sender:

Please note to enclose a note in the returned parcel with the original order number which can be found on your order confirmation.

The BARBARA I GONGINI Brand will not accept returns for any non-faulty items that have been worn and tags removed. Upon receipt of an order, if any item has been received with no tags, customer should notify us (by phone or e-mail) on the same day if they wish to return. We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging. In the event of any failure to return any goods to us within the stipulated time limits, even though validly cancelled, we shall have the right to charge any costs of recovery of the goods. Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU). Faulty Item If the item you received is faulty, please report so when writing an email to shop@barbaraigongini.dk, quoting your order number, your name and address, details of the product and the reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. You have 30 days from receipt of the faulty item to return it to us. Shipment of wrong items If the item you received is not what you originally ordered, please report so when writing an email to info@barbaraigongini.dk quoting your order number, your name and address, details of the product and the reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. This returns policy does not affect your statutory rights.

Når varen er sendt fra vores lager, sendes en retlig bindende faktura via e-mail. Denne faktura udtrykker de varer, der fysisk ligger i din pakke. Af fakturaen fremgår dit pakkenummer og transportør, så du kan spore forsendelsen hos den pågældende transportør.

Fra du har modtaget din ordrebekræftelse, kan der gå 1 - 5 hverdage, inden du modtager dine varer.

Husk, at der ikke omdeles pakkepost om lørdagen. Hvis en vare i din bestilling er udsolgt, vil dette blive oplyst på din faktura. Du bliver kun faktureret, og betaler derfor kun, for de varer, du får leveret

Beløbet for varerne trækkes først fra din konto, når varerne afsendes af BARBARA I GONGINI A/S. Vi kan aldrig trække et større beløb, end det du har godkendt ved købet. Betalingssystemet på BARBARA I GONGINI A/S online shop er godkendt af PBS, og vi opkræver ikke gebyr ved betaling.

 

SIKKERHED

Betales der med betalingskort, er du altid sikret mod misbrug. Vores internetbutik fungerer i samarbejde med bl.a. PBS (Pengeinstitutternes Betalings Systemer), og vi beskytter de data, der transporteres via nettet i forbindelse med køb, ved hjælp af SSL (Secure Socket Layer) kryptering.

Hverken BARBARA I GONGINI A/S eller andre har mulighed for at se dataene. Så længe du kigger rundt på vores hjemmeside, er der ingen kryptering, men når du skal til at indtaste dine betalingsoplysninger, kreditkortnummer, udløbsdato mv. går du ind i et såkaldt "sikkert" område. BARBARA I GONGINI A/S modtager ingen oplysninger om dit kreditkortnummer og/eller udløbsdato, men får melding om, at et beløb er reserveret til BARBARA I GONGINI A/S til senere overførsel, når vi har ekspederet din ordre. Når bestillingen er sendt videre til vores transportør, overfører det reserverede beløb til vores konto hos PBS.

Du har mulighed for at afvise en betaling, når du modtager din betalingsoversigt. Du har ingen selvrisiko i tilfælde af, at dit kort bliver misbrugt i en internet-butik, der benytter SSL (Secure Socket Layer) i sit betalingssystem. Dermed er du bedre sikret end i den fysiske verden.

 

FORSENDELSE

De bestilte varer sendes direkte hjem til dig som en privatpakke. Du skal kvittere hos postbuddet eller på posthuset efter din pakke. Dette pakkeprodukt kaldes "forsendelse med modtagerkvittering". På den måde er du sikker på, at din pakke ikke udleveres forkert, og vi er sikre på, at vores forsendelse har fundet sin rette modtager.

En fast forsendelsesomkostning (porto) på ca. 40 kr. tillægges hver enkelt ordre, uafhængigt af antal varer i din bestilling. Ved bestilling over kr. 1.500,- er forsendelsesomkostningerne gratis.

 

BESKADIGELSE UNDER TRANSPORT

Hvis varen beskadiges eller går tabt under transporten, er BARBARA I GONGINI A/S erstatningsansvarlig. Du skal dog meddele problemet til BARBARA I GONGINI A/S (se adresse og kontaktinformationer øverst på denne side).

 

FORTRYDELSESRET

Du har altid 14 dages fortrydelsesret, når du handler hos BARBARA I GONGINI A/S. Fortrydelsesretten løber fra den dag, du har modtaget din vare. Fortrydelsesretten kan kun udnyttes, hvis varen tilbageleveres i væsentligt samme stand og mængde. Fortrydelsesretten bortfalder altså, hvis du bruger varen på en måde, som helt åbenbart forringer varens salgsværdi. Når fortrydelsesretten udnyttes, skal du selv betale portoen for at sende varen retur.

Venligst husk at vedlægge en seddel inde i returneret pakken med det oprindelige ordrenummer, som kan findes på din ordrebekræftelse.

Du kan også fortryde ved at nægte at modtage varen ved levering, jf. dog punkt 10. Når du fortryder dit køb, tilbagebetales købesummen til dig. Dette gøres ved en overførsel til din bankkonto, når vi har fået varen retur og kontrolleret, at den lever op til reglerne for fortrydelse. Det er derfor vigtigt, at vi får oplyst dit registreringsnummer og kontonummer.

Det er ikke et krav, men ekspeditionen fremmes, hvis fyldestgørende informationer følger pakken - eksempelvis en udfyldt returseddel, kopi af evt. forudgående korrespondance mv.
Der følger altid en returseddel med din ordre - den ligger i pakken.

Bemærk, vi modtager ikke pakker sendt pr. efterkrav til os.

 

EJ AFHENTEDE VARER

Hvis vi får en forsendelse retur, som ikke er blevet afhentet på posthuset, betragter vi dette som en fuldgyldig returnering.

 

REKLAMATIONSRET

BARBARA I GONGINI A/S garanterer for, at de varer du bestiller, er fejlfrie ved leverancen.

Når du handler online hos BARBARA I GONGINI A/S, har du 24 måneders reklamationsret. Dette betyder, at du enten kan få pengene tilbage eller et afslag i prisen, afhængig af den konkrete situation.

Dette betinger, at reklamationen er berettiget, og at manglen ikke er opstået som følge af en fejlagtig brug af produktet eller anden skadeforvoldende adfærd. Der skal reklameres inden rimelig tid, efter at du har opdaget manglen ved varen. Hvis der reklameres inden to måneder, vil reklamationen altid være rettidig. Vi refunderer rimelige forsendelsesomkostninger, som du måtte have i forbindelse med returnering af varen, når reklamationen er berettiget. For at få dækket dine forsendelsesomkostninger bedes du huske at påføre dem på retursedlen.

Når du returnerer varen, bedes du angive en beskrivelse af fejlen. Brug gerne retursedlen, dette er ikke et krav, men det letter vores behandling og minimerer tiden for reklamationen. Hvis din returseddel er bortkommet, og evt. dit ordrenummer, og ca. hvornår varen er købt.
